This Prenuptial Agreement ("Agreement") is made and entered into on this ______ day of _______________, 20__, by and between _____________________ ("Party One") and _____________________ ("Party Two"), collectively referred to as the "Parties".

WHEREAS, the Parties intend to marry each other, and in consideration of such marriage, and other valuable considerations, they desire to establish their rights and responsibilities regarding each other's property;

WHEREAS, the Parties each desire to establish their rights and responsibilities regarding their respective incomes, assets, and debts, and to determine the division thereof in the event of separation, divorce, death, or another event;

NOW, THEREFORE, in consideration of the forthcoming marriage, and in consideration of the mutual promises and covenants contained herein, the Parties agree as follows:

1. Disclosure of Assets and Liabilities

The Parties each acknowledge that they have had a full opportunity to investigate the financial status of the other, including full disclosure of assets, liabilities, and income. Attached hereto as Exhibits A and B are the respective financial statements of Party One and Party Two. The Parties agree that these financial statements fairly and accurately disclose their respective financial states as of the date of this Agreement.

2. Property Rights

Subject to the laws of the State of Illinois, including but not limited to the Illinois Marriage and Dissolution of Marriage Act (750 ILCS 5/), this Agreement sets forth the rights of the Parties in and to property owned by either or both of them. Each Party shall retain all rights in property owned by them prior to the marriage, and all increases, decreases, and substitutes thereto, as well as property acquired in their own name during the marriage.

3. Maintenance and Support

Each Party waives any right to maintenance or support from the other in the event of separation or divorce to the fullest extent permitted by law, except as specifically provided for in this Agreement.

4. Amendment and Revocation

This Agreement may be amended or revoked only by a written agreement signed by both Parties.

5. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict law provisions.

6. Complete Agreement

This Agreement constitutes the entire agreement between the Parties and supersedes all prior discussions, agreements, or understandings of any kind.
